PromNight COVID-19 Refund Policy

REFUNDS are not normally issued. However, due to the COVID-19 pandemic, we will issue a refund, subject to the non-refundable service fee, in the event your event cannot be postponed and is cancelled due to restrictions relating to COVID-19, imposed by a governmental authority having jurisdiction. If your event is postponed, no refund will be issued. However, partial or full refunds (subject to the non-refundable service fee), may be considered in circumstances outside of the participant’s control, when supported by a written request which includes supporting documentation, such as the participant having moved outside of the event region.

Service charges on PromNight.ca ticket purchases cover a combination of non-refundable fees inherent to such transactions. These include:

• The fees banks charge us to process your credit card payments. We do our best to keep these charges as low as possible — and lower than most similar charges you’d encounter with ticketing services such as Ticketmaster.
• Ancillary ticket processing fees.
• Non-refundable booking deposits and associated administrative fees.
• Additionally, the advent of the COVID-19 pandemic has necessitated the implementation of additional safely protocols that, though costly to execute, are essential for everyone’s well-being.

Approved refunds will be made to the participant’s original purchase method.

CONDITIONS OF SALE

This ticket/wristband is a personal, revocable license. All tickets and wristbands are non-refundable, non-transferable, and non-replaceable in the case of loss or destruction. Tickets are only valid on the event date. Unused tickets have no cash value. The event is subject to change without notice. 1763229 Ontario Corporation may postpone, cancel, interrupt or stop the event due to adverse weather, dangerous situations, epidemics, or any other reason beyond the control of the Corporation. If the event cannot be held or is cancelled before the event commences for any reason beyond the control of the Corporation or its subcontractors/co-promoters, all reasonable efforts will be taken to reschedule the event. Under no circumstances will a refund be granted to a holder who is unable to attend a rescheduled event.

The holder agrees to submit to a reasonable search of his/her person and belongings prior to entry to the event to ensure compliance with these conditions. The following items are restricted, may not be brought onto the bus or into the event, and may be confiscated by the Corporation, its agents, subcontractors, co-promoters, and/or assigns: alcoholic beverages, illegal drugs or drug paraphernalia, weapons of any kind, food products purchased outside the event, containers, thermoses, bottles, fireworks or firecrackers, animals, and large bags or backpacks. The holder acknowledges that once admitted to the event, there are no in and out privileges, and smoking is only permitted in designated locations.

The holder grants to the Corporation a fully paid, perpetual right to all photographs, video or audio recordings of the holder taken or made at the event by the Corporation, its agents, entertainers, employees, subcontractors and/or co-promoters, and assigns, and hereby consents to the use, reproduction, broadcast and distribution of said photographs, video or audio recordings for promotional and marketing purposes for the Corporation.

The holder acknowledges and voluntarily assumes all risks and danger related in any way to the event including, without limitation, risks of personal injury, property loss and/or damage, arising or resulting from any cause whatsoever and whether occurring prior to, during, or after the event. The holder agrees that 1763229 Ontario Corporation, its agents, entertainers, employees, subcontractors and/or co-promoters, and assigns are expressly released and forever discharged by the holder from any and all claims arising from or relating to such risks or otherwise occurring at or in connection with the event.

The holder hereby agrees to indemnify, defend and hold the Corporation and all officers, directors, owners, agents, entertainers, employees, subcontractors and/or co-promoters, and assigns (collectively “the indemnified parties”) from and against any and all liability and costs incurred by the indemnified parties in connection with any claim arising out of any breach of these conditions by the holder.

The Corporation reserves the right without refund or compensation to seize or cancel the ticket, withdraw the license granted above, refuse admission and/or expel a holder who damages the venue in any manner whatsoever and/or whose conduct is disorderly, verbally or physically abusive, disrespectful, harassing, poses a threat to security, or to the enjoyment of the event by others, or due to any violation of the conditions.

If any of the provisions (or parts thereof) contained in these Terms and Conditions are determined to be void, invalid or otherwise unenforceable by a court of competent jurisdiction, such determination shall not affect the remaining provisions (or parts thereof) contained herein.
